Understanding Islamic Estate Distribution (Faraid)
The Islamic law of inheritance (ilm al-Faraid) is described by Prophet Muhammad (PBUH) as "half of knowledge." Unlike conventional probate where estate division is discretionary, Islamic law specifies mandatory fixed shares (Furud) in the Holy Quran (Surah An-Nisa 4:11, 12, 176).
The 4 Essential Steps of Estate Settlement
- Funeral & Burial Expenses: Reasonable costs associated with the burial without extravagance.
- Debt Liquidation: Paying off all outstanding financial debts owed to creditors and religious duties (unpaid Mahr, fast expiations).
- Execution of Wasiyyah (Bequests): Fulfilling voluntary bequests up to a maximum of 1/3 of the remaining estate to non-heirs.
- Distribution of Remaining Net Estate: Dividing the remaining 2/3 or full net estate among legitimate Quranic heirs.
Primary Heir Categories & Fixed Fractional Shares
- Spouse: Husband receives 1/2 (without children) or 1/4 (with children). Wife receives 1/4 (without children) or 1/8 (with children).
- Parents: Father receives 1/6 (plus residual if no sons). Mother receives 1/6 (with children) or 1/3 (without children).
- Sons & Daughters: Sons and daughters inherit residuary shares with a ratio of 2:1 (son receives double the daughter's share).
